Making sure to respect the standard HRDD steps:
Identify and assess adverse impacts
Prevent or mitigate harm
Track effectiveness
Communicate transparently

Provide or cooperate in remediation

The fashion industry’s harm is rooted in fast fashion and overconsumption. Governments should consider regulating the volume and quality of clothing imported into their territories; for instance, by restricting entry of ultra-low-quality garments. This would pressure companies to prioritise durability and sustainability.

Introduce a ban on exporting low-quality clothing waste to other countries and instead develop domestic recycling and upcycling systems, taking full responsibility for the industry’s environmental externalities.

Governments must also take responsibility for workers exploited through outsourcing and offshoring. They should track patterns of corporate delocalisation, investigate the reasons behind them, and impose national standards that prevent social and environmental dumping.

Enact and enforce laws ensuring civil liability and access to effective remedies for victims of corporate abuse, both domestically and abroad.

Require companies to adopt binding adaptation plans that guarantee respect for workers’ rights, dignity, and environmental protection across their supply chains.

Mandate transparency reports and create independent monitoring mechanisms to ensure accountability.

Champion a multilateral, binding convention on Human Rights and Environmental Due Diligence (HRDD) at regional or international level.

Review bilateral investment treaties (BITs) that currently shield companies from accountability and prevent victims from directly suing corporations.

Reward ethical companies through tax incentives, public procurement advantages, or recognition schemes.

Invest in and promote circular economy models that prioritise reuse, repair, recycling, and responsible consumption.
